Those Pesky Don’t Do Digital Clients - Another Way to Market Them

The beauty of digital transmission of photos is that one image can be seen in forty (or forty million!) different places– all at one time. I wish that I could write that all photobuyers are accepting, or are ready to accept digital images via disk or on-line. They aren’t. Even though the digital concept is sound, and the technology is available, many of your photobuyers may continue to cling to 20th century methods for accepting transparencies only.

We are all faced with the dilemma and transition that this technology presents us. Should we “wait” until the greater majority of our photobuyers are up to digital speed, or should we operate as if digital photography did not exist?

My advice would be: Go at it, ‘business as usual.’ Here at PhotoSource International we find that 90% of editorial photobuyers have made the switch to digital. However, what you do about those lucrative accounts that still have not made the transition? As long as you’ve developed existing clients, you can always make the transition to digital when they are ready. Eventually, when they are ready to make the transition (it’s usually a budget decision), you’ll be able to offer advice. By helping them through the transition period you’ll have increased their dependence on you as a supplier.

INTERIM MARKETING
In the meantime, you’ll need to wrestle with the age-long problem of sending original transparencies to those photobuyers on your Market List.
Since your images are your stock in trade, you want to have them available when you get a photo request. If some of your original transparencies are at a photobuyer’s, being held for consideration, those images are tied up and can′t be out there available for sales opportunities.
Stock photographers are put in a bind when a photobuyer holds a transparency longer than normal. (“Normal” is two to three weeks.) On the one hand, if, after three or four weeks, you ask for the transparency’s return, you might lose a possible sale. And on the other hand, if you let it remain at the publishing house, you have taken it out of circulation and others can′t see it (or buy it).

One of the answers to this dilemma is to always make “in-camera dupes″ when you are photographing with film. This way you’ll always have extra “originals″ and not be at a disadvantage when one buyer holds your picture(s) too long. Then you can circulate these other “similars” to buyers on your list who “don’t do digital.”

THEY’RE HOLDING YOUR IMAGES

What is an acceptable amount of time to hold an image? Magazines, with their short turn-around time, will usually hold a picture no longer than two weeks. Book publishers, in contrast, because of the complexities of putting an entire book together, will hold a transparency six to eight weeks or more, depending on the situation.

Publishers to avoid are those who by their actions show a disregard for photographers and little or no sensitivity to their need to keep pictures moving. Either because of faulty administrative practices or just plain ineptitude, these photo editors tend to hold transparencies well beyond a fair length of time. Publishers of bird, horse, and pet magazines, particularly, will often be lax and sometimes cantankerous in their attitude toward photos and photographers. (This comes from their advantage of having a huge number of photos and photographers to choose from.)

NO WORRIES: THE PERMANENT FILE

Probably the best way to solve the “holding” problem is to place your duplicate slides in a publishing house(s) that maintains a “Permanent File.” This, of course, would be publisher you’ve worked with a good while, and who has a track record for handling photographers well.
In their central art library, an administrator files your (reproduction-quality) duplicate slides or B&ampW prints for possible future use. When a photo researcher at the publishing house uses one of your pictures, you receive a check. After publication, the image is returned to the central file until it is re-used, and a fee again is paid to you, usually 75% of the original fee they paid you.
This no-worry method has been used for years by longtime stock photography professionals.

THE DIGITAL ADVANTAGE

Once your publishing house begins to realize the digital advantage of storing photos for reference in this manner, you will be able to scan appropriate photos in your collection and download them digitally to a publishing company’s central art library. It’s much more to your advantage to keep your digital pictures with a trusted buyer, rather than hoard them at home where no one can see them.

As far as thievery goes, yes, I have had a couple of reports where a new art director has come in and assumed that all the photos in their digital file belonged to the publishing house and therefore were accessible. However, we’re speaking of the early stages of a new technology, and a new working method, and such change is always fraught with mistakes and inconsistency. Give it a chance. You’ll find that as we progress in this new digital era, we’ll find fewer and fewer errors.

You’ll also update your digital collection when you return from a trip or assignment. You’ll repeat this process with each of the small core of publishing houses you work with. And, because you are a specialist in their specialized interest area (aviation, dog training, environment, agriculture, butterflies, backpacking) there will be little need for them to go outside their central library to obtain that “just right” image.

3)Ninjas rely on cunning skill and black magic tricks to accomplish their mission. Webmasters often resort to black hat SEO tricks in order to get their pages ranked well in Google and Yahoo.

4)Ninjas use smoke bombs to disappear. Webmasters are much more advanced in this area. They do not even need smoke bombs. They often disappear without notice. You have a better chance of getting a Ninja on the phone in 2005 than you do your programmer.

5)Ninjas use deception as a tactic to confuse and spread fear. Webmasters deceive everyone. Only they can understand their massive file structures.

6)Ninjas use their special insight to view the source of their enemy’s power. Webmasters use ‘view source’ as an age old intelligence gathering technique about their enemy.

7)Ninjas use a secret code to communication to other ninjas. Webmasters use heavily coded languages to IM other designers. No one has any idea what they are talking about.

8)Ninjas have been known to throw sharp metallic objects when encountering an enemy. Webmasters have been known to throw metallic data processing units across the room when encountering a blue screen.

9)Ninjas are hired because the client doesn’t want to confront the enemy himself. Webmasters are hired because the client doesn’t want to confront “HTML for beginners” himself.

The Light of Ki’Shara: Part 2

Sa’nah awoke with a start! She felt cold. Not the external type that afflicted the skin but the one that chilled the soul.

Earlier that evening, they had sought shelter from the elements in an abandoned cave.

Now, as she sat up, her senses coming alive, the wisdom of that decision seemed dubious. She was sure she heard something stir from within the cave depths.

Sa’nah got up, carefully laying aside the blanket and crept from where she was so as not to disturb Ka’diysh and ventured into the darkness.

It’s not as if she wasn’t aware of the danger, she was, but it’s as though there was this compelling force that wrestled her common sense to the ground holding it captive as she proceeded.

As she stole away she glanced back at her aged Mentor; the warmth of the Glow-Stones kept him toasty and comfortable so that his sleep was both satisfying and deep.

Sa’nah melted into the ebony shroud of the cave and continued until the only sound was that of her faint footsteps furtively falling on the passage floor. What had she heard? Was it real?

Then she saw them.

They appeared to be hybrid Human and Black-Hound. She could, by the small light of the Moon-Stone necklace she wore, discern that there were two of them.

These beasts lacked the menacing demeanor of the former minions of The Nameless One and exhibited uncannily human characteristics. For one thing, they walked uprightly and secondly, they spoke.

“Hello, Youngling,” crooned the first Were-Beast as it came within talking distance.

“You can speak?” Sa’nah asked, more a statement than a question.

“Of course we do young Princess, after all, we wouldn’t make good negotiators if we lacked speech would we?” The second Man-Hound replied.

“A proposal!” He declared. “Our Master has decided to offer you and the Priest safe passage to Ellendale for one small token.”

“What’s that?” Sa’nah asked, still not completely trusting her senses to the unfolding scenario.

“Have you ever heard of The Elmerydian?” Inquired the first of the two creatures.

“Of course.” Sa’nah said, some pride spilling over the edges of her words. “I am an Adept-in-Training. It is mine to know such things. What is it to you, creature? I’ve dealt with your kind before and I’m not afraid of you!”

“Of course not, Princess.” Chimed the second beast. “You have Andalyon blood in your veins. You know no fear, right?”

Just then Sa’nah felt her chest beginning to constrict and became aware of the difficulty in breathing.

“Wha..? What’s h-h-hap…?” She gasped, sinking to her knees.

Why Princess, whatever is the matter? Beast # 2 asked, a sly smirk spreading all over his face.

“Sa’nah?” The voice sounded strange, as though coming from some unfathomable depth. “Sa’nah!” It began growing stronger. “Listen to my voice, Princess! Listen to ME!”

The Man-Hounds pressed in and Sa’nah felt like a vise was slowly crushing her ribcage.

“No weapon of fear shall afflict my soul, in Jzhan Christell I’m fearless and bold.” The words ascended from her spirit as though on wings. “I have overcome and conquered all, by the power of Jzhan mine enemies fall.” The Were-Beasts began dissolving into thin air right before her eyes. Sa’nah recognized the divine presence of The Light of Ki’ Shara releasing the healing balm of His words into her soul.

“Sa’nah!” The voice was insistent but reassuring. Slowly, she opened her eyes to the pastoral face of her Mentor, Ka’diysh. “You suffered another residual psychic attack.”

“So, I did.” Sa’nah responded. This time there were two of them, some kind of Man-Beasts but He delivered me just like He promised to. I can still sense His presence with me!”

“The Light of Ki’ Shara is faithful to His word, Sa’nah. He will ALWAYS perform it!” Ka’diysh had that far away look in his eyes as though remembering some past personal promise fulfilled.

“How long will the attacks continue, Ka’diysh?” Sa’nah’s eyes were hopeful.

“You’ve passed the worst, Princess; I sense his power has weakened. The Nameless One can only bully the ignorant and you are anything but. Keep meditating on the words of The Scrolls, in them is healing for the spirit and soul.”

“As I think on Him all strife must cease, for He will keep my mind in peace.” Sa’nah quoted from the VeoCode as they bowed their heads in prayer.

Thumbs Up-Thumbs Down

Who says a thumbnail photo can’t be swiped from the Internet?

Could a legitimate company swipe thousands of thumbnail-size images and sell them, say, for advertising, to a cell phone company for downloading? And still be legal?

Well, presently they could, if they went through an innocent major search engine that featured image-search.

This is the story of an adult-content company (Perfect-10) who leases (for $$$$) thumbnail-sized “adult pictures” to a British cell phone entity (Fonestarz Media Ltd.), obtaining those pictures for free from displays of photos on major search engine websites such as Google.

Thumbnails can now be marketed on the Web in a number of ways, so this now presents a problem for stock photographers.

A brief history: Over the years we have reported on this question. In 2003 a California photographer, Leslie Kelly, sued a company called (at that time) Arriba Soft, and asked, “Can a search engine tap into photographers’ web photos and display them on their own search engine website?”

The case took several years to decide. The courts finally came up with an answer (in layman’s terms): “Yes, web search engines can display a photographer’s images, if they use them in a ‘thumbnail format.’”

That’s why we see Google and the other search engines freely displaying the photos of photographers (and non-photographers) on the search engines’ websites in small (thumbnail) low-res format, with no legal problems.

TECHNOLOGY CHANGES

But technology changes. In the early days of the automobile it might have been legal to place your arm out of the window of your car to signal which way you were about to turn. But with the invention of electronic turn signals, it eventually became illegal to use your arm for the signal. You are required now to have a working turn signal on the car you drive. A faulty one could lead to a fine. Who knows what future technological changes hold in store for the rules of the road.

Such a change has come to stock photography. Thumbnails are used all over on the Internet, and to date, there have been few objections by photographers because they have served, usually, as mini-publicity points for the photographers. We’ve all thought, until recently, that thumbnails don’t qualify technically to be able to be used for commercial purposes. We as photographers have been conditioned to believe thumbnails are “safe” from thievery. Here at PhotoSource International, we’ve heard of no thumbnail copyright infringement cases in the last decade, except for the Leslie Kelly case.

But a recent court case has beamed a new light on this subject. The Ninth Circuit Court of Appeals originally handled the Kelly complaints. They are taking a second look.

The recent case, Perfect 10 v. Google, Inc., brought in the United States District Court for the Central District of California, is about Google’s image search function in the form of thumbnail-size images as part of its search engine services. Google, relying on the Kelly decision, declared that its use of thumbnails is considered “fair use” under the Copyright Law.

The preliminary ruling in the Perfect 10 case, said that the major factor differentiating Google’s use of Perfect 10’s images, from the 2004 case of Arriba Soft’s use of Kelly’s images, was that since early 2005, Perfect 10 licensed reduced-size images of its photographs to Fonestarz Media Ltd. of the United Kingdom. Fonestarz sells reduced-size copyrighted images for download and use on cell phones worldwide. The company sells about 6,000 thumbnails per month in Britain alone. The same thumbnails which Perfect 10 holds copyright registrations for, were being made available for downloading from Google’s image search engine. The images are free from Google. You have to pay to obtain the images from Fonestarz.

That’s not the way photo-owners like to work.

This is something the courts didn’t recognize in their decision back in 2004. Leslie Kelly had not established that he made sales on thumbnails. The Court, likewise, made the presumption (like we all did) that there was no market for thumbnail-size images, and that included Kelly’s.

IS IT FAIR USE ?

How is this going to turn out for stock photographers?

On the one hand, searching and finding images within the Fair-Use doctrine of the Copyright Law has become imbedded in the web search culture. Can the search engines continue to offer this service, or will they start charging for thumbnails and acting as a broker for the photographers who own the copyrights to the images?

The concept of this kind of micro payment is not new. Look at recording artists and composers, and radio broadcasting. Originally, radio stations only broadcast performers live. Later, recordings became widely used. Performers wanted to be paid, and many composers didn′t want their music performed or played for free, but the stations wouldn′t pay them. The composers who were members of ASCAP boycotted radio in 1944, and no music was broadcast for several months.

Eventually the broadcasters agreed to pay “royalties” for each time a musician’s recorded tune was broadcast. Thus began the system of royalty micropayment.

We are Super Alien Beings in Virtual Reality Dreams

What is the life experience? Why are we here? It is there a god? What is the meaning of life? These are all questions that mankind over the ages has asked and there always seems to be someone who is willing to try to answer them in order to control mankind.

Recently I talk to a science-fiction author who stated; “Maybe we are all super alien beings and we are in the virtual reality dreams where we have chosen as characters to be human beings.”

At first I thought the guy was nuts and then I realized he was brilliant. What a beautiful synopsis for a radically new genre in a modern-day science fiction flick. Indeed the movie would be almost like a Matrix type movie. Imagine if we were all super intelligent beings and when we died, we would simply go through a transitional phase of waking up and we would not be human at all.

The whole setting would be a reality of virtual experience so real that while we were in the virtual reality dream we actually believed that we were human beings, a much lesser intelligent species than we really are.

Yes, that is what I thought; what a trip indeed. After drinking our coffee we parted ways and the science-fiction author who is working on a book with exactly this concept said to me; “I have another idea I want to run by you and you are going to love it!” And I said; “I cannot wait until we meet again Sir.” Consider all this in 2006.

In Search of the Great Australian Novel

What was the funniest novel of the 20th century? Christopher Hitchens recently pondered that question in the course of awarding the palm to Lucky Jim. I want to ask a more modest question. What is the funniest novel of the 21st century — this brand-new, post-9/11 century that already shows so many promising signs of being even more fouled-up than the last? To anybody who has read A Dancing Bear, that vast and rowdy tale of love, post-modernity, serial murder and terrorism, the answer won’t be in any doubt. Unfortunately almost nobody has read it. To date the book has only been published online. Its author, who variously calls himself Mark Osher, David Free and Kirk Kinbote, and who — if you believe his website — may not even still be alive, is rumored to have pulled out of at least two publication deals at the eleventh hour, after the houses involved sought to make unacceptable cuts to his text. In consequence the book is little known of outside its author’s native Australia, and even within Australia it has reached only a tiny circle of readers.

What, then, is the novel about? It opens on an unnamed university campus, where the protagonist — an amiable enough young cipher named Fenton Bland — has just joined a society of student Maoists in order to get near the girl he loves. These Maoists will prove a troublesome bunch. In an effort to demonstrate that communism is not yet dead, they perpetrate, or at least try to perpetrate, an increasingly rococo series of terrorist outrages. Bland, who is at heart a law-abiding fellow with no authentic taste for radical politics (”Like fellatio and death,” we are told, “Maoism had always struck him as one of those things that happened to other people”) finds himself in an increasingly urgent quandary: he must either go on pretending to be a terrorist, running the risk that one of the Maoists′ outlandish plots might one day succeed, or he must forever wave goodbye to his slender hopes of making the girl his.

That is the book’s spinal storyline, its central moral MacGuffin. Further plots and characters cavort on the book’s periphery. There is Pamela Scratch, a former childhood acquaintance of Bland’s who has now morphed into an incredibly fiery student activist. Her current project is to lobby for the unconditional release from custody of a patently guilty thrill-killer named Neville Aggot (”Campaigning for the release of a multiple murderer … even Bakunin would look at that and say, ‘Jesus that’s left-wing!’”). Bland intensely dislikes her but is nonetheless condemned to go on having coffee with her on a bi-monthly basis in perpetuity, because he believes, although his memory is shaky on the point, that he might well have touched her, when they were playing in a sandpit at the age of five, on the pudendum.

Then there is the eminent post-structural theorist Ivan Lego, who, in keeping with his thesis that “every speech act is an act of linguistic genocide,” produces a book consisting wholly of blank pages. The work becomes a bestseller. Osher/Free/Kinbote reproduces a four-page “extract″ of Lego’s book by leaving four pages of his novel blank. This is but one instance of what is, at least for this reader, one of the novel’s central mysteries. Is it an attack on post-modernism, or an exercise in it? Or is it both things at once?

Meanwhile the Maoists’ terror campaign is hotting up. Various kinds of atrocity are contemplated. A junior Maoist proposes the use of a car bomb. “I’m listening,” replies the chief Maoist, “provided you′re not referring to my Kombi.” Death lists are drawn up. The Maoists resolve to target the increasingly famous — and increasingly fatuous — Ivan Lego. The option of running him over with a motorbike ridden by a suicide bomber is canvassed, but scrapped as a logistical nightmare. (”Why bother with a bomb at all, if you′re already going to be creaming the bloke with a motorbike at top speed? You can’t kill the guy twice. And what if the bomb doesn’t go off at exactly the right instant? What do we do then? Dismount from the wreckage and just sort of run after him till the thing explodes?”)

It soon dawns on the reader that all the book’s plots are coming marvelously together. Neville Claude Aggot escapes, and attempts (with merciful lack of success) to go on a rampage of “non-consensual sex and death.” The Maoists decide, for reasons too complicated to go into here, to slay Lego in the style of a serial killer and pin the crime on the still-at-large Aggot. The scene in which Bland and the chief Maoist, packing a meat cleaver and a tomahawk respectively, attempt — with wildly differing levels of enthusiasm — to enter the theorist’s home in the dead of night is a tour de force of comic writing.

As indeed is the whole book. This novel, believe me, is not destined to remain obscure for long. It is only a matter of time before everyone will be talking about it. Check it out while it’s still a curio, a cult item, a hidden pearl in the great weedy dripping haul of the Internet.

God is unborn but the Life Dimension does even if it can never die but it always changes dreaming about more worlds in the same time with the accumulation of new energies! The Dimension of Life is given by the Life Factor. The origin of the Life Factor consists of measuring My first vibrations as Existence Personalization, that come from the Person near the Original Thought and the Sole Accidental Great Creator. This measure is always transformed based on My Harmonic or Disharmonic Conditions, determining new and new measures each of them identified as Life Factors and holding as much different characteristics, but I will tell you all about them in good time.

“Did God know in advance what the Life Dimension would dream to temperate same negative impulses from its dreams as suffering from the earthly world, for example, Godlike Light?”

God has nothing thought in temporal terms because the temporality is an illusion become reality. More entities that are spiritual have had same common elements of dream, giving birth to Life Dimension. The Free Will exists just in your dream about world because this is nothing else than God existence reflected in Himself in reality. I am referring here to a reality of Basic Truth.

If God had been opposed to Life Dimension dreams, He would cancel any hope or wish. If He had canceled the happiness or the sadness indifferent of world and Life Dimension , God would have to accept the death for real. He would break the eternal life cup in the distant limits of the original energy, which is God Himself!

I know, Sorin, how hard is to die in a world just to be born again in other, but to be alone even if would be a cure for this problem. God would accept it because He is more than love and that you can imagine. God is everything!”

“I can’t understand, Godlike Light, how God Himself is able to find either cure for the suffering. It has created by Life Dimension dream and given to those born under this sign or Factor, with such big coolness and generosity in the earthly world where same simple dead bodies will be same day closer in the eyes of those remained to taste from the worldly unhappiness pot.”

No, I will not tell you that God let the people to pass hard moments to prepare them for I don’t know what!”

“But Godlike Light, the people pass many troubles and sufferings in one life than all real happiness of hundreds thousand or maybe milliard people.”

“Yes Sorin, it is plenty true, but I would like now you to answer me how could God create just you in the whole Universe?

This would mean that you are the only person from all these worlds, indifferent of the Life Dimension , which dreams them.

If you had been not a simple dream, which disappeared in the morning, a dream with its pain, joy and despair, would you think it was better without all these?

First, you wouldn’t be!

Never, talking about time, you wouldn’t know you are, you have a certain identity, you breathe and your life is your hands.”

“Yes Sorin, your life is your hands because God has given you the possibility to escape from your own life from you through death!”

“But Godlike Light, it’s not so simple to kill yourself in the world of dream with times and spaces where I come from.”

“You are right, Sorin. It’s not so simple to kill yourself just for realizing more deeply the abyss, which follows you to pass if you want this. If you have passed the world limit with earthly time, where you were born, you wouldn’t come back as much you wanted.

As I already told you, to escape from all unhappiness you wouldn’t have to be a simple dream of a Life Dimension but to be created in a special way by God.

I don’t tell you hoe big the pain is because you exist but you are alone.

you want to share with somebody your happiness of being unique in that moment, anybody but to share, because as much unique you are you will never be totally alone, even if you know the real values axis of the Basic Truth. The oneness consists in diversity as diversity in oneness.”

“You are right, Godlike Light, but was God the first that have given birth to Life Dimensions or other similar energetic centers to determine the dreams, wasn’t He?

The dream of this Life Dimension has determinate the human being to become a social one with the whole scaffolding, which derives from this. Under the protection of the dream are days that I have to carry until death.

If the human being hadn’t been dreamed as a social one but it had been against any communication or relation with other similar beings, the oneness concept would be free to live besides diversity. Because the being exists as nonsocial one, the diversity will find no more the same necessity quotient as social. This thing has already happened.

I don’t remind you the fact that the human thought logic is binary. Therefore, the evil will be reported to good, the ugliness to beautiful, and the oneness to diversity.”

It is always a wise practice to do your homework on a company before doing business with them. There are many unscrupulous companies in today’s world that you want to avoid. How can you tell? What avenues are there in determining what company is best for you?

A good place to look is the Better Business Bureau. Some things to consider when looking up a company report:

Is the Company Listed? - If not, that should be a big red flag. They are either too new, are flying under the radar so as not be noticed, or they aren’t a registered company.Complaints Ratio - Compare the number of complaints to the company’s customer-base they are servicing. If the company has a high rate of complaints, more than 5% of its customer base, then they have a customer service problem. Less than 2% to 3% is an acceptable range. There will always be customers, for some reason or another, that are never satisfied. You’ve probably dealt with some.Resolution of Complaints - How many complaints have not been resolved? This indicates if a company makes an effort to resolve customer issues.Rating - What type of rating has the BBB given this company?
